Article 11 of the European Convention on Human Rights protects the right to freedom of assembly and association, including the right to form trade unions, subject to certain restrictions that are "in accordance with law" and "necessary in a democratic society".

“Article 11 – Freedom of assembly and association

1. Everyone has the right to freedom of peaceful assembly and to freedom of association with others, including the right to form and to join trade unions for the protection of his interests.

2. No restrictions shall be placed on the exercise of these rights other than such as are prescribed by law and are necessary in a democratic society in the interests of national security or public safety, for the prevention of disorder or crime, for the protection of health or morals or for the protection of the rights and freedoms of others. This article shall not prevent the imposition of lawful restrictions on the exercise of these rights by members of the armed forces, of the police or of the administration of the State.

What Podemos’s present success reveals is the breakdown, the crisis or the collapse (choose the term you prefer) of the Spanish party system. Because in reality the Transition regime is sinking like the Titanic and Podemos is merely the iceberg that caused this. So as soon as the cock crowed on 25-M, all the captains aboard began to jump ship: firstly [PSOE leader] Rubalcaba, then the King, later [the Catalan conservative] Durán, … It is a regime crisis because its previous dominant coalition, until now formed by an imperfect three-party set (PSOE, PP and [regional nationalists]), has lost the ability to impose its cultural hegemony.

The rise of Podemos has taken support away from PSOE, the Socialist Party, which has lost 7.5% in the polls. It has also won a significant slice of voters fromIzquierda Unida, the United Left, whose support has fallen three points to around 8%. Fortunately, Podemos has indicated that they are willing to discuss with the United Left in order to create a united front. Such a non-sectarian response can only help to strengthen the Left alternative. This radical alternative is also mirrored in Catalonia where the left wing Catalan nationalist group Ezquerra Republicana (Republican Left) appear to be improving its position in comparison to its more right-wing Catalan party rival in the run up to the independence vote proposed for this November.

This was driven by occupations of town squares and mass citizen assemblies, providing a striking counter-point to the Spanish state’s bureaucratic and frequently corrupt “politics as usual”. ANOVA in Galicia and the Catalan left-nationalist Popular Unity Candidacies (CUP) were forerunners of Podemos as forces organising political representation “from below”.

The Spanish Civil War was one of the most complex and bewildering conflicts of the 20th century. Occurring directly before WWII, it is a conflict often overlooked by non-Spaniards; outside of the country, the war’s importance was quickly overshadowed by the world war, and beyond this, the Great Powers of the day – Britain, France, Germany, Italy, and the Soviet Union – pursued a non-interventionary policy, at least on the surface (the latter three nations actively shipped arms and troops to Spain, in defiance of a British-led non-interventionary agreement all had signed).
