La Cour de Justice de l’union européenne (CJUE) a stipulé dans une récente ordonnance qu’un éditeur de logiciels ne peut s’opposer à la revente des licences « d’occasion », qu’elles aient été distribuées sur un support matériel (CD, DVD) ou immatériel (téléchargement).
Entreprises et particuliers peuvent se rassurer : revendre une licence logicielle « d’occasion » est tout à fait légal, selon la Cour de Justice européenne. Ainsi, lorsque un éditeur vend un logiciel, il « conclut en même temps, contre paiement d’un prix, un contrat de licence accordant au client le droit d’utiliser cette copie pour une durée illimitée », et donc « ce titulaire vend cette copie au client et épuise ainsi son droit exclusif de distribution ». Bien entendu, ceci est valable que le logiciel ait été vendu sur support physique comme un DVD, ou immatériel et donc téléchargé.
